Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Veloforge mobile application and related services (the "Service") operated by Veloforge LLC ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

1. Important Health and Safety Disclaimers

1.1 Not Medical Advice

The Service provides general fitness and training information for educational purposes only. The content provided through the Service is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, athletic trainer, physical therapist, or other qualified health provider with any questions you may have regarding a medical condition, injury, or fitness program.

Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately.

1.2 Assumption of Risk

You acknowledge and agree that:

• Physical exercise, including but not limited to baseball training, throwing programs, weighted ball training, strength training, and conditioning exercises, carries inherent risks of injury, including but not limited to muscle strains, ligament tears, tendon injuries, joint injuries, stress fractures, and other acute or chronic injuries.
• Baseball-specific activities, including pitching, throwing, and velocity training, carry specific risks of arm injuries including but not limited to ulnar collateral ligament (UCL) injuries, rotator cuff injuries, labrum tears, elbow injuries, and shoulder injuries.
• Weighted ball training and velocity development programs carry additional risks and should only be performed by athletes who are physically mature and healthy.
• You are voluntarily participating in these activities with full knowledge of the risks involved.
• You assume full responsibility for any and all risks of injury or illness that may result from your use of the Service or participation in any exercises, programs, or activities suggested by the Service.

1.3 Physical Readiness

Before beginning any exercise program provided through the Service, you represent and warrant that:

• You have consulted with a physician and have been cleared for physical activity and the specific types of training offered through the Service.
• You are not aware of any medical condition that would prevent you from safely engaging in physical exercise.
• If you are a minor, your parent or legal guardian has reviewed these Terms, consented to your use of the Service, and acknowledged the risks involved.
• You will immediately stop any exercise and seek medical attention if you experience pain, discomfort, dizziness, nausea, shortness of breath, or any other warning signs.
• You understand that arm soreness and fatigue are warning signs that should not be ignored, and you will modify or cease throwing activities accordingly.

1.4 Program Limitations

You understand and acknowledge that:

• The training programs provided are general recommendations based on the information you provide and are not personalized medical or therapeutic advice.
• The Service cannot account for all individual factors that may affect your health, safety, or performance.
• Automated program generation cannot replace the judgment of qualified coaches, athletic trainers, or medical professionals who can observe and evaluate you in person.
• You are responsible for modifying or discontinuing any exercise that causes pain or discomfort.
• Training recommendations regarding throwing volume, intensity, and rest are guidelines only and may need to be adjusted based on your individual response.

1.5 Youth Athletes

For users under 18 years of age:

• A parent or legal guardian must review and agree to these Terms on behalf of the minor.
• Parents/guardians are responsible for supervising youth athletes' use of the Service and their participation in recommended exercises.
• Youth athletes should be evaluated by a qualified professional to determine physical readiness for advanced training methods such as weighted ball programs.
• We strongly recommend that youth athletes work with qualified coaches and follow age-appropriate guidelines from organizations such as USA Baseball, MLB Pitch Smart, and the American Sports Medicine Institute (ASMI).

1.6 Mechanics Analyzer (Experimental Feature)

The Mechanics Analyzer feature uses pose estimation technology to analyze pitching videos. You understand and acknowledge that:

• This feature is experimental and is provided for educational and informational purposes only.
• AI-generated analysis is not a substitute for evaluation by a qualified pitching coach, biomechanics expert, or medical professional.
• The accuracy of the analysis depends on video quality, camera angle, and other factors outside our control.
• Analysis results are general observations and may not accurately reflect your individual mechanics or injury risk.
• You should not make training decisions based solely on AI analysis results.
• You are responsible for ensuring you have the right to upload any video content and that it does not violate any third-party rights.

2. Limitation of Liability

• Your access to or use of (or inability to access or use) the Service;
• Any injury, illness, or physical harm resulting from exercises, training programs, or activities performed in connection with your use of the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

You specifically acknowledge that Veloforge is not liable for any injuries, including but not limited to arm injuries, muscle injuries, joint injuries, or any other physical harm, that may occur as a result of following training programs, exercises, or recommendations provided through the Service.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all claims exceed the amount you paid us, if any, for use of the Service during the twelve (12) months prior to the claim.

3. Indemnification

You agree to defend, indemnify, and hold harmless Veloforge and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any privacy right or intellectual property right;
• Any claim that your use of the Service caused damage to a third party; or
• Any injury or harm you sustain while using the Service or following any training program, exercise, or recommendation provided through the Service.

4. Use of the Service

4.1 Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have your parent or legal guardian's permission to use the Service, and they must agree to these Terms on your behalf.

4.2 Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4.3 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws;
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks;
• Interfere with or disrupt the Service or servers or networks connected to the Service;
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission;
• Use the Service to transmit any viruses, malware, or other malicious code;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Veloforge. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, the parties agree to attempt mediation before pursuing any other form of dispute resolution.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Entire Agreement

These Terms constitute the entire agreement between you and Veloforge regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
